By listing the names of each of my children and signing below, I, on behalf of myself and as parent or legal guardian on behalf of my children, agree to the following:
1) ASSUMPTION OF RISK: I have read and understood the above warnings concerning COVID-19. I hereby choose to accept the risk of being exposed to, contracting or spreading COVID-19 for my children in order to allow my children to attend classes on-site at Oak Hill, participate in before or after-school activities at Oak Hill, and enter onto the premises of Oak Hill. These educational services are of such value to me and my children that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order for my children to utilize Oak Hill’s educational services and premises in person.
2) WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right, and as parent or legal guardian on behalf of my children I forever release and waive their right, to bring suit against Oak Hill and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Oak Hill’s educational services and premises. I understand that this waiver means I and my children give up our right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I and my children may have to seek damages, whether known or unknown, foreseen or unforeseen.
3) COMMITMENT TO FOLLOW HEALTH PROCEDURES: I hereby commit to following the procedures set forth by Oak Hill in the “Health Risk Policies and Procedures” and the “COVID Policies and Procedures” in order to best care for my family and the other families at Oak Hill.
4) MEDIATION: I hereby agree to submit any legal dispute with Oak Hill for mediation before a mutually agreed-upon mediator, or if none can be agreed upon, one selected by Peacemaker Ministries. Lawsuits between believers, or threats of lawsuits between believers, are a matter of grave concern for Oak Hill, are contrary to biblical and church teaching, and mediation is an effort to resolve disputes in a biblical fashion. Mediation will be governed by the Rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation (ICC Rules), unless modified as stipulated by the parties. In particular, subject to the more detailed provisions of the ICC Rules, mediator(s) will attempt to assist us in reaching a voluntary settlement of any disputes through mediation. The confidentiality of the mediation process will be protected and these matters will not be discussed with people who do not have a necessary interest in them. If a settlement can be agreed upon, the conciliators may, at their discretion, issue an advisory opinion. Neither the opinion nor any communications exchanged in the mediation process, will be admissible for any purpose in any subsequent legal proceeding.
